City of Costa Mesa Accepting Applications for Marijuana Business Permits

In California, local governments have authority over the regulation of marijuana businesses. This means cities and counties are able to ban or allow the operation of marijuana businesses within their borders. Therefore, getting city approval is required before applying for a license with the state to become fully able to operate as a legal marijuana business.

On November 7, 2016, voters in Costa Mesa passed Measure X, which allows for the operation of certain medical marijuana facilities within its borders. The measure intends to regulate the distributing, manufacturing, processing, research and development, testing and transporting of cannabis and cannabis-related products.

Measure X allows for five different types of medical marijuana business permits including distribution, manufacturing or processing, testing, research and development, and transporting. Details on each type of medical marijuana business permit are outlined below. Each permit requires a Conditional Use Permit with approval from the city Planning Commission and a city Business License.

Distributor

A distributing permit is necessary for the procurement, sale, and transport of medical cannabis or medical cannabis product between entities that are currently in compliance with all applicable state and local laws and regulations pertaining to the medical marijuana business and medical marijuana activities. The direct and/or retail sale, distribution, or furnishing of any cannabis or cannabis product to any consumer or end user is prohibited.

Manufacturer / Processor

A manufacturing or processing permit is required for producing, preparing, propagating, or compounding medical cannabis or medical cannabis products, directly or indirectly, by extraction methods, independently by means of chemical synthesis, or by a combination of extraction and chemical synthesis.

Testing Laboratory

A testing permit is required for performing tests of medical cannabis or medical cannabis products and that is both of the following:

  1. Accredited by an accrediting body that is independent of all other persons involved in the medical cannabis industry in the state.
  2. Registered with the State Department of Public Health, and is owned and operated by a person issued a valid medical marijuana business permit for laboratory testing from the city is currently in compliance with all applicable state and local laws and regulations pertaining to the medical marijuana business and medical marijuana activities.

Research and Development Laboratory

A research and development permit is necessary for performing research into and/or the development of medical cannabis or medical cannabis products, where cannabis in any amount is located on-site, and that is both of the following:

  1. Accredited by an accrediting body that is independent of all other persons involved in the medical cannabis industry in the state.
  2. Transporter

A transporting permit is required for the transferring of medical cannabis or medical cannabis products from the permitted business location of one licensee to the permitted business location of another licensee, for the purposes of conducting medical marijuana activity authorized by the MMRSA.
