City of Long Beach Accepting Applications for Marijuana Business Licenses

In California, local governments have authority over the regulation of marijuana businesses. This means cities and counties are able to ban or allow the operation of marijuana businesses within their borders. Therefore, getting city approval is required before applying for a license with the state to become fully able to operate as a legal marijuana business.

The citizens of Long Beach, California voted to approve the regulatory portion of Measure MM on November 8, 2016. This approval made the operation of medical marijuana businesses legal in the City of Long Beach, including medical marijuana dispensaries, delivery, manufacturing, cultivation, distribution, and laboratory testing. At this time, the city is not issuing licenses for recreational marijuana businesses.

There are five different types of licenses for medical marijuana businesses, which are outlined below. 

Cultivation

A cultivation license is required to operate a facility where medical cannabis is planted, grown, harvested, dried, cured, graded, or trimmed, or that does all or any combination of those activities.

There are four different types of cultivation licenses available for application:

  • Type 1A: Specialty Indoor Cultivation; Small- Between 501 and 5,000 square feet of total canopy
  • Type 2A: Indoor Cultivation; Small- Between 5,001 and 10,000 square feet of total canopy
  • Type 3A: Indoor Cultivation; Medium- Between 10,001 and 22,000 square feet of total canopy
  • Type 4: Cultivation; Nursery

Dispensary

A dispensary license is required to operate a facility where medical cannabis, medical cannabis products, or devices for the use of medical cannabis or medical cannabis products are offered, either individually or in combination, for retail sale, including an establishment that delivers, pursuant to express authorization by local ordinance, medical cannabis and medical cannabis products as part of a retail sale

There is a maximum of 32 available dispensary licenses for issuance to conduct Medical Marijuana Dispensary activities in the City of Long Beach.

The application period for dispensaries is currently closed. The application period will only be re-opened if a dispensary license is surrendered or revoked pursuant to Long Beach Municipal Code Section 5.90.080. 

Manufacturing

A manufacturing license is required to produce, prepare, propagate, or compound manufactured medical cannabis or medical cannabis products, either directly or indirectly, by extraction methods, independently by means of chemical synthesis, or by a combination of extraction and chemical synthesis.

There are two types of manufacturing licenses available for application:

  • Manufacturing Level 1 M-Type 6: Nonvolatile Solvent/No Solvent Manufacturing
  • Manufacturing Level 2 M-Type 7: Volatile Solvent Manufacturing

Distribution

A distribution license is required for the procurement, sale, and transport of medical cannabis or medical cannabis product between entities that are currently in compliance with all applicable state and local laws and regulations pertaining to the medical marijuana business and medical marijuana activities.

There is only one type of distribution license available for application.

Laboratory Testing

A laboratory testing license is required to operate a facility, entity, or site that offers or performs tests of medical cannabis or medical cannabis products.

There is only one type of laboratory testing license available.

Proof of ISO 17025 accreditation will be required in order to receive a Medical Marijuana (Cannabis) Testing Laboratory Business License. Testing Laboratories licensed by the City will have six (6) months to obtain a Medical Cannabis Regulation and Safety Act (MCRSA) Type 8 Testing Laboratory license upon notification that the State is issuing such licenses. If a Testing Laboratory fails to obtain a Type 8 Testing Laboratory license within six months, the City may revoke the local Testing Laboratory business license.

Applications for new licenses are being accepted Monday through Friday, from 7:30 AM to 4:00 PM at Long Beach City Hall. Applications are reviewed in the order they are received, and there is currently no deadline for application submission.
