North Dakota Medical Marijuana Manufacturing License Guidelines
- Compassion centers are required to maintain appropriate security, including well-lit entrances, an alarm system that contacts law enforcement, and video surveillance. They may not be located within 1,000 feet of a school, and they will be subject to inspections and other rules.
- Applicants will pay a $5,000 non-refundable application fee and, if they are approved, a $110,000 for manufacturing facilities.
- Compassion center licenses will be granted based on a merit-based application process, which will consider: the suitability of the proposed location; the applicants’ character and expertise in related fields; the proposed centers’ plans, including for record keeping, safety and security, staffing and training, preventing diversion, and for pesticide-free cultivation; whether the applicant has sufficient capital; and its ability to make medication affordable for all patients.
- Each staffer of a compassion center must apply for and be granted a registry photo identification card. They must be 21 years of age or older and must not have been convicted of an excluded felony offense or a recent drug misdemeanor.

North Dakota Medical Marijuana Dispensary License Guidelines

- There is a non-refundable $5,000 application fee to submit a proposal (application) and a $90,000 certification fee upon issuance of license.

The History of North Dakota Marijuana Business Licenses Marijuana
In 2016, North Dakota voted in the general election to approve Measure 5. The medical marijuana initiative provided that qualifying patients would be able to obtain marijuana from state regulated non-profit compassion centers-and use marijuana if recommended by their physician. It included a provision for patients outside a 40 mile radius of a compassion center to cultivate a limited amount of marijuana for their own use.
Before Measure 5 was signed into law, state legislature wrote a number of modifications and further definitions, substantially changing the law. In 2017, Governor Doug Bergum signed the final bill, now SB 2344, into law. By then, the number and range of qualifying conditions had been greatly reigned in, the kinds of cannabis to be prescribed had been lowered (no edibles or concentrates), and the provision for home cultivation had been revoked. A specific pediatric “oil” would be created for minors, and all minors (19 and under) would need parental permission.
Two medical marijuana manufacturing facilities have been selected to move forward with the business registration process. The two entities selected are Pure Dakota LLC, located in Bismarck, and Grassroots Cannabis (legal name GR Vending ND LLC), located in Fargo. The state accepted applications for Dispensary Licenses in three phases. The final application phase closed on February 26, 2019.
